Can I sue Uber or Lyft directly?

It's complicated. Because drivers are classified as independent contractors, you generally can't sue Uber or Lyft for the driver's negligence directly. However, you CAN access their commercial insurance policy — up to $1 million — which is often better than suing the company. In some cases involving negligent hiring we can also pursue the company directly.

What if the Uber driver wasn't on a trip when they hit me?

If the driver's app was on but they hadn't accepted a ride yet (Period 1), Uber/Lyft provide limited contingent coverage of $50K/$100K. If the app was completely off, only the driver's personal insurance applies. We identify which period applies and pursue every available source of coverage for you.

How long do I have to file a rideshare accident claim in NY?

Generally 3 years from the date of the accident for a personal injury lawsuit. However, for no-fault PIP benefits, you must file within 30 days of the accident. Do not wait on no-fault — that deadline is absolute and strictly enforced.

What if I was partly at fault?
